1. Information Tracking and Usage
To the extent it is permitted by applicable laws, NineSix (in the following referred to as “NineSix” or “we”) tracks and gathers certain information on this website that helps us to better understand our visitors’ needs related to our website and our services. We will never share this information with third parties unless explicitly stated in this policy or ordered by a court of law.
2. Request of Information
On some pages of our website users have the option to register for various NineSix services – e.g. newsletter, download of whitepapers, etc. – using data capture forms. These forms usually require the user’s name, email address, company, as well as other information that is necessary to provide the requested service. The user may choose to provide additional non-mandatory information that enables us to provide a more personalized service. To the extent it is permitted by applicable laws, we may also directly contact website users on the basis of the information they have provided in order to promote NineSix’ products. In case of requests form countries in which are not handled by NineSix itself but by affiliated companies or other representatives, we may also transfer the data to the responsible affiliated company or representative for said purpose (in each case only to the extent it is permitted by applicable laws). The users can object to the use of their data as described above at any time.
Our website uses “cookies”. Cookies help us understand our visitors’ needs and interests, and we use that information to improve our website and the services offered on the individual pages. They are not linked to any personally identifiable information. If a user rejects the cookie, our site may still be used, however the user’s access to some areas of our website may be limited.
NineSix specifically uses Google Analytics and Retargeting cookies to allow 3rd party service providers to provide advertisements on our behalf across the Internet. These service providers may collect your IP address and non-personally identifiable information about your visits. This is completely anonymous and does not include your name, address, email address or other personal information. Additionally, these cookies are used to gather anonymous statistical information on how the website is browsed. These cookies will expire after 10 years.

6. Other Types of Information Gathering
Occasionally our website gathers visitors’ data via temporary marketing activities such as seminars, free trial accounts, surveys, etc. Participation in these activities is on a voluntary basis, which allows the visitor to decide whether to disclose any personal data or not. Such data may include contact information (e.g. name, email, phone number), demographic information (e.g. zip code, date of birth) or others. The data will be used to provide the visitor with the service requested. Data gathered via surveys will be used for improving our website and services.
7. Changing/Editing Personal Information
Every email sent by NineSix allows the user to change, edit or remove any information he provided to us at the time of registration for an NineSix service or the contact request on the website.
Users who wish to no longer receive our newsletter or promotional emails may click on a link named “Unsubscribe” which is embedded with every email sent by NineSix in order to not receive future messages.

NineSix takes it’s responsibility towards the recipients of its clients seriously and has implemented a no tolerance spam policy. Any customer found to be using NineSix' services for spam will be immediately cut-off from use of the product. 11. Definition of SPAM
The recipient’s personal identity and context are irrelevant because the message is equally applicable to many other potential recipients.
The recipient has not verifiably granted deliberate, explicit, and still-revocable permission for it to be sent.
The transmission and reception of the message appears to the recipient to give a disproportionate benefit to the sender.
NineSix requires all its clients to comply with the current legal requirements regarding SPAM, commercial electronic messages and the collection and protection of personal information, in place in both the client’s country of residence and the client’s geographical area of operation (i.e. where the client’s recipients are based). These legal requirements include:
The CAN SPAM Act of 2003 (Controlling the Assault of Non-Solicited Pornography and Marketing Act), The Directive on Electronic Commerce (2000/31/EC) of the European Parliament and Council of 8 June 2000, on legal aspects of information society services, in particular, electronic commerce in the Internal Market, and The Directive on Privacy and Electronic Communications (2002/58/EC) of the European Parliament and Council of 12 July 2002, concerning the processing of personal data and the protection of privacy in the electronic communications sector.
12. NineSix Member Agreement
As part of the contractual Terms of Service, NineSix’ clients agree to using NineSix’ applications and infrastructure only to send emails – or other electronic messages – to customers and prospects that have explicitly consented (opted-in) to receive emails from them and refrain from sending unsolicited emails (=SPAM). Any client found to be sending SPAM using our application and infrastructure is subject to immediate contract and service termination and potential legal action. In addition, NineSix does not buy or sell mailing lists nor endorses the use of purchased, rented or harvested mailing lists by any of our clients.
13. Mandatory Unsubscribe Options
Every email sent through NineSix’ application or sending infrastructure must contain an unsubscribe link that is both clearly visible and easy to use. The unsubscribe functionality must not require the recipient to send an unsubscribe request via email or to login to a user account first.
14. Reporting SPAM by an NineSix Client
Should you suspect that you may have received an unsolicited email from an NineSix client, please send an email to abuse [at] ninesix.ro that contains the following information:
- Full details on sender name and/or from address
- The email address the suspected SPAM has been sent to (Important: it may differ from the one that you are sending us the complaint from)
- The time and date you received the email. NineSix thoroughly investigates every single SPAM complaint. Should we be able to trace the affected email address we will immediately remove it from the relevant client mailing list.
- Other options for reporting SPAM by an NineSix client, is to use the “mark/report as spam” functionality offered by leading Webmail providers, such as Gmail, Yahoo, etc. or use anti-SPAM blacklist provider, such as Spamcop, which provide an easy way to report unsolicited emails.
